THE PERSPECTIVE OF DATA PROTECTION WITHIN THE SCOPE OF CHILDREN'S AND ADOLESCENTS' RIGHTS IN THE BRAZILIAN LEGAL SYSTEM

This study investigated Brazilian legislation relating to the protection of personal data of children and adolescents, in particular, the General Data Protection Law (LGPD) and the Child and Adolescent Statute (ECA). The starting point of the research was the right to privacy, guaranteed by the Universal Declaration of Human Rights and reinforced by the Brazilian Federal Constitution. This investigation examined how the LGPD, which came into force in 2018, requires the explicit consent of parents or guardians to process the intimate information of minors. The research method was bibliographic, based on the analysis of the Greater Law, the permissives cited, the doctrine and judicial decisions to examine the robustness of the legal protection in question. The results showed that Legislative Act No. 13,709/2018 complements Regulation No. 8,069/1990, as it specifies the terms for obtaining, using and disposing of the target audience's personal characters, while the ECA provides a comprehensive framework for protection of the prerogatives of individuals. The study highlights that the aforementioned legislation contributes to protecting the privacy of Brazilians up to 18 (eighteen) years of age in the digital world, however, the standards need to be continually improved to face the new challenges of this.
