ARTIFICIAL INTELLIGENCE AND THE USE OF MUSICAL WORKS FOR TRAINING NEW PRODUCTS

Considering the exponential advancement of generative artificial intelligence technologies and their ability to create musical works without direct human intervention, this study begins by questioning originality as an essential element of copyright protection. The objective is to investigate how copyright law, especially in the Brazilian context, responds to the challenges posed by automated creations, analyzing the tension between human authorship, informational use, and consent in the use of musical works for training AI systems. To this end, a comparative analysis is carried out between the legal models of Brazil, the United States, the European Union, and Japan, observing the different criteria adopted to define originality, as well as the implications of the technical use of protected works. Thus, it is observed that the absence of specific regulation on the use of copyrighted data in the context of AI has allowed the appropriation of human creations without authorization or remuneration, revealing a regulatory vacuum that favors economic interests to the detriment of creators. It is concluded that the consolidation of an autonomous legal category of informational use and the strengthening of authorial consent are urgent measures to ensure a balance between technological innovation and authorial justice in the algorithmic era.
